Heated discussion is fine when we also have care, concern and respect for others’ options and right to be heard as well. At the core of our principles it honesty. We call others out when they are deceptive and untruthful thus, we need to hold truth and honesty as our litmus, as well.

Website Privacy Statement

This policy establishes how our organization will use information we gather about you from your visit to our website. The privacy of our members is of the utmost importance to our organization.

For example, we may count the number of visitors to the different pages on our website to help make those, future pages and related content more useful to visitors. This information does not identify you personally. We automatically collect and store only the following information about your visit:

e-Newsletter Privacy Statement

ACT UP NY values your privacy! We NEVER SELL, RENT or LOAN out your name or private information to anyone, ever! We do have a newsletter and do send email announcements strictly on a confirmed, opt-in basis. Beyond opt-in, bulk email we send individual emails from our working members to you as part of any support requests that you have initiated, or in case we have to contact you about work we are doing on your behalf. ACTUP NEW YORK, INC. SALES AND USE TAX POLICY STATEMENT

We have prepared this sales tax policy statement to explain to you when and why we collect sales tax on your purchases.

IMPORTANT NOTICE: Even if we do not collect sales tax from you, you may owe sales tax on your purchase. Unless you live in Alaska, Delaware, Montana, New Hampshire, or Oregon, your state most likely requires purchasers to report and pay tax on all purchases that are not taxed at the time of sale. The tax may be reported and paid on your individual income tax return or by filing a consumer use tax return. For more information, please visit your state’s department of revenue website.

ACTUP NEW YORK, INC. COLLECTS SALES TAX in the one state where we have physical presence (or nexus), New York.

ACTUP NEW YORK, INC. DOES NOT COLLECT SALES TAX in any state NOT listed above because ACTUP New York, Inc. is not required to collect sales or use tax in these states.

Credit Card Policy

Cards Accepted: Online we accept: Visa, MasterCard, American Express, JCB, Discover, and Diners Club. Over the phone and at the time of an event: we do not currently accept Diners Club.

Secure Online Transactions: We use several payment processors to accept and process credit cards at the time of an online donation or at the time of a face-to-face event. When using a credit card online, we do not store credit cards in any way. Any, entire, initial, online one time donation or subscription donation checkout process is handled by either: Stripe or PayPal and they store your sensitive credit card information.

Agreement to Resupply Card Info: Sometimes, subscribers and donors make additional requests or if for some other reason we need to manually process an additional charge or authorization, we may request you call us and supply your card details over the phone. In this case, the additional charges will be billed by one of our payment processors.

Bring your Cards with You: You agree to bring any and all cards used for any online and telephone transactions with you and to resupply those cards and any others that you wish to use when we have a pre-paid, special event or a merchandise pickup or delivery.

30 Day Return Policy

ACT UP NY is very appreciative of your support and while we encourage folks to select their items carefully by checking the size guide for each item prior to purchase, we realize that “fit” in particular can be a difficult thing to evaluate without the garment in front of you. Therefore, we have a 30 Day Return and Exchange policy so that you can buy with confidence and return an item for a refund or exchange to a size that is closest to what you expected in the first place.

  • Return Shipping Policy: Unfortunately, as a small non-profit we are unable to pay for the return shipping on items that you want to exchange or refund. Luckily for most, our merchandise is lightweight and inexpensive to mail back to us.
  • Return Tracking Policy: We endeavor to give you the highest level of customer support so we naturally like to know where things are and tracking is our way of ensuring that your return goes smoothly (tracking is often free—ask before you purchase postage).
  • Tax Policy: Applicable taxes will be retained and remitted, pursuant to state and local laws. For a full explanation, see our: Sales Tax Policy.
  • Supersession Policy: All cancellation policies may be superseded for safety reasons, or extenuating circumstances. In which case, we will be the sole decider of what refunds, if any, may be given.
  • Third Party Fee Policy: Any third party booking, shipping or credit card payment fees may not be refunded if a third party charges a fee that won’t be refunded to us. We must deduct any third party fees regardless of the type or reason for a cancellation not initiated by us.
Want to request an exchange, now?

To Initiate an Exchange:

We gladly accept returns and exchanges for merchandise purchased within the first 30 days so long as the customer pays the return postage and obtains a valid tracking number from their post office for the returned package. Additionally, items must be in the original state (unwashed, unworn, unused, etc.).

  1. Pack the item carefully for return shipping (so that it doesn’t get damaged in transit thus voiding the return).

  2. Ship the item back to us from your post office requesting a “TRACKING CODE” and enter that number on the Request Return form. Be sure to include a copy of your original invoice or packing slip. We need your order number to be able to process the request.

  3. With your tracking number in hand, fill out the “Return Form” which can be found on a “Returns & Exchanges” tab located on each Product Page.

  4. Be sure to give an “Exchange Reason”.

  5. Let us know what Product and Size you would like it exchanged for, if you would like a store credit or even a refund.

What if an Item is defective or arrives damaged?

Did you receive defective merchandise?

While we triple inspect every item that leaves our fulfillment center, on rare occasions something gets past us. Sorry about that! To get it resolved right away, please email customer service at: shop.help@actupny.com, and include:

  1. Your order number.

  2. A description of what is wrong.

  3. A photo or two of the issue (if possible) as this can greatly speed up getting you a replacement.

Who pays for the return shipping?

Customers must pay for all shipping charges including any return postage, tracking fees, and the shipping for a new, exchanged item back to them as well.

Nondeductible Contribution and Acceptance Policy

Contribu­tions to ACTUP NY or other section 501(c)(4) organizations generally are not deductible as charitable contributions for federal income tax purposes.

Acceptance of any contribution, gift or grant is at the discretion of the ACTUP NY. The ACTUP NY will not accept any gift unless it can be used or expended consistent with the purpose and mission of the organization.

No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.

The ACTUP NY will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation. That said, we are a 501(c)(4) Political Organization and contributions to us are not deductible for federal income tax purposes as charitable contributions.

The ACTUP NY will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the ACTUP NY.

Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for ACTUP NY.

The ACTUP NY will provide acknowledgments to donors meeting tax requirements for property received by the organization as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by ACTUP NY.

The ACTUP NY will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the ACTUP NY will restrict information about the donor to only those staff members with a need to know.

The ACTUP NY will not compensate, whether through commissions, finders’ fees, or other means, any third party for directing a gift or a donor to the ACTUP NY.

Admin Access Agreement

TERMS

AGREEMENT: By using the Administrative functions of this website, or by becoming an Administrator, Editor, or Contributor (Admin) you are bound to everything on this page. PLEASE, READ CAREFULLY.

  1. No Credential Sharing: Never share your username or password with someone else. Our system can detect shared credentials and, by sharing credentials, you damage a factor in our determining and sensing if there is unauthorized activity which can result in: loss of data and our forcing all other users to reset their passwords.

    Your indiscriminate actions can cause hours of extra work, loss of all recent posts, and the temporary loss of access for all other Admins, not to mention inconvenience for other Admins.

    Example Scenario: You are at an Action or Demo and need to post an update to the website. However, you aren’t able to post and so, you give your credentials to another trusted member so that they can post for you. The system then detects the intrusion and locks out all other users (and deletes all updates made in the last 24 hours, as a security precaution) and causes a manual reset of all passwords which takes days to implement. The results of your action are that no user can post to the website for days and the recent updates to the website (presumably about the demo or action) are now gone.

  2. No Snooping: You agree to access and alter only the information for which you have responsibility or authorization, and not to view information that you have no need or authorization to see as part of your responsibilities. Access to or use of the ACTUP NY website and the data it contains for your own personal gain or profit, for the personal gain or profit of others, to satisfy personal curiosity, or for any other reason except as specifically authorized by ACTUP NY is strictly forbidden.

    Notice: we keep detailed logs of all user activity and we can later tell that you’ve been snooping. This snooping can often be uncovered weeks later during a security audit.

    Example Scenario: You are in the WordPress admin area and you see a Draft Post from someone else. It looks interesting, and you click Edit to view the post. While reading the post you get distracted (the phone rings) and you forget that you have the Edit Screen open and this creates a condition where the original Author can’t edit their post until you close your Edit Screen. Worse yet, your browser later crashes resulting in a condition where the post is permanently locked. You have no idea that this has happened and that you’ve just “innocently” locked another Admin out of their file. They have to recreate the page again or contact support–all because you were curious. This example may seem trivial but the point is that when you access things that you have no business accessing you increase the risk that you may do something wrong or that something unexpected may happen and since you had no reason to be using that file or functionality there is added trouble in fixing and finding the root cause of the incident by the support staff.

  3. Respect Confidentiality: You will respect the confidentiality of individuals to whose information you have been given access. You will not view or disclose that information except as required by your responsibilities and as allowed by ACTUP NY policies and/or applicable law.

  4. Abuse of Privilege: You understand that the transactions processed with your ACTUP NY access may be audited, and appropriate action will be taken if improper uses are detected. Logging in as others without demonstrating organizational need, attempting to alter security profile information, and purposefully transferring/deleting/altering a task without a cause are examples of misuse. You understand that abuse of your privileges is strictly prohibited.

  5. Follow All Policies and Procedures: You agree to follow the privacy, security, and other policies and procedures established by ACTUP NY, as well as: the terms and conditions of gPowerHost providing hosting services for ACTUP NY, state and federal security and privacy laws and regulations that apply to the use of my ACTUP NY access.

    Note: ACTUP NY’s hosting company has a strict Anti-Spam Policy and violating that policy by sending out unsolicited bulk email can easily result in the loss of hosting services and serious damage to ACTUP NY’s Email Reputation which will follow ACTUP NY to any new hosting company they decide to move to.

  6. Revocation of Access Rights: You understand that, should you leave your current post or position, either through transfer or termination, your access rights will be revoked, unless your new position requires you to perform the same duties.

FAILURE TO COMPLY: We reserve the right to refuse service and access to any Admin not adhering to the above rules or our requests. Additionally, we reserve the right to remove any content or contribution or, terminate any access agreement, if in our sole opinion, we feel they have violated these terms or refused any safety, security, privacy, or information request and we reserve the right to do so without any prior warning, notice or other procedure.

You understand that you will be held responsible for the consequences of any misuse occurring due to any neglect on your part.
